Consent agreement

Jun 11, 2024

On June 11, 2024, a panel of the Inquiry Committee approved a consent agreement between BCCNM and the registrant to address practice deficits that occurred from January to June 2023 related to the registrant diverting narcotics from the workplace and falsifying documentation to conceal their diversion activities. The registrant was diagnosed with and admitted to a disability with a causal relationship to the practice issues via an independent medical evaluation and they have agreed to comply with the treatment recommendations.

The registrant has voluntarily agreed to terms equivalent to a limit and/or condition on their practice, including:

  1. A reprimand.
  2. Medical monitoring for a minimum of four years including regular reports that they remain compliant with this monitoring.
  3. Disclosure of treatment recommendations to relevant employer representative(s).
  4. A period of restricted access to narcotics, benzodiazepines, controlled substances, and the “zed" class of drugs for a term, followed by supervised access by a nursing peer for a term.
  5. A gradual return to work starting with supernumerary status gradually progressing to fulltime hours.
  6. A limit whereby they are restricted from working night shifts, acting as the nurse in charge, working overtime, having supervision over students, or orientation over new staff, for a term.
  7. Remedial education in ethics.

The agreement will remain in place for a minimum of five years of continuous nursing practice. The name of the registrant has been withheld in accordance with section 39.3 (4) (a) of the Health Professions Act for the purposes of not identifying a registrant or their personal health information respecting the condition that impaired their ability to practice nursing or midwifery.

The Inquiry Committee is satisfied that the terms will protect the public.
