On February 28, 2019 a panel of the Inquiry Committee approved a Consent Agreement between BCCNP and Richard Ivor Davies of Kamloops, British Columbia, to address practice and conduct concerns related to professional responsibility and accountability knowledge based practice, client-focused provision of service, and ethical practice.
On November 30, 2017, Mr. Davies reacted to a patient with a neurodegenerative condition, who was known to be unable to regulate her behaviour, with the use of physical force contrary to her care plan and not in keeping with the clinical situation. Mr. Davies physically led the patient to a breakfast table, and when she became agitated, he restrained her arm behind her back and walked her to her room. When the door was opened he pushed her with force into her room, causing her to fall.
The patient's care plan directed staff to use a number of distraction techniques to manage the patient who frequently became agitated when her requests for food and other items were not immediately met. The care plan specifically directed staff to avoid physical contact with the patient when she was agitated.
Mr. Davies' actions were contrary to BCCNP standards and Interior Health Authority policy.
Mr. Davies is a Former Registrant. He has voluntarily agreed to a one month suspension due to the significance of this type of conduct on patient safety, and vis-à-vis in the nursing profession. Mr. Davies also agreed to complete remedial education and to complete a regulatory practice consultation with respect to the provision of ethical care to vulnerable patient populations. These actions would commence upon successful reinstatement of practising registration, should he meet the registration requirements of character, competence, and fitness at a future date.
The Inquiry Committee is satisfied that these terms will protect the public.
