On Dec. 11, 2023, a panel of the Inquiry Committee approved a Consent Agreement between BCCNM and Nicolette Rivera (the Registrant) of Surrey, B.C., to address her breach of multiple terms of a consent agreement she entered into with BCCNM related to multiple deficiencies in her nursing practice.
The Registrant breached several terms of her consent agreement when she obtained and began two different nursing positions with two different British Columbia Educational Institutions. She did not advise her BCCNM Monitor of her new employment and, as a result, disclosure of her Consent Agreement was not made to her employer in a timely manner. Further, the Registrant did not develop, review, and/or update a learning plan applicable to her new employment settings as required in order to support her in her nursing practice as required by her consent agreement.
The Registrant's actions served to frustrate the ability of BCCNM to monitor and ensure her safe, competent, and ethical nursing practice. The Registrant's breach of her consent agreement was not inadvertent and the conduct that breached her consent agreement extended over a lengthy period of time.
BCCNM requires that registrants in consent agreements comply with all of the terms to which they have agreed in order to consensually resolve a complaint about their nursing practice. The failure to do so is a serious matter which undermines BCCNM's ability to protect the public and serves to erode the public's trust in a self-regulating profession.
The Registrant has agreed to the following:
A suspension of their nursing registration for 4 weeks;
Remedial education in ethics.
The Inquiry Committee is satisfied that the terms will protect the public.
