On August 20, 2021,The Honourable Mr. Justice D.M. Masuhara rendered his decision in the appeal of this matter. The result was that the finding of one allegation was quashed and three other findings of the Discipline Panel were remitted back to the Discipline Panel for reconsideration. The Discipline Panel is currently reconsidering three findings.​

Following the issuance of the September 11, 2019 order, the Discipline Panel set a schedule for written submission from the College and from Ms. Whieldon with respect to penalty and costs. The College provided written submission on October 10, 2019, Ms. Whieldon provided a response on November 11, 2019, and the College provided reply submissions on November 25, 2019. The Panel then requested clarification from Ms. Whieldon and received same by December 11, 2019, with a last further reply from the College on December 18, 2019.

After deliberation, the Discipline Panel ordered that:

  • Ms. Whieldon is reprimanded
  • Ms. Whieldon's registration will be suspended for 12 months
  • Ms. Whieldon will be subject to 36 months of limits and conditions on her nursing registration following this order, including:
    • ​an enduring limit prohibiting Ms. Whieldon from ever working in perinatal nursing again
    • a limit precluding her from being the sole RN on duty
    • a limit of employment to a single nursing unit
    • extensive remedial education
    • a condition to develop a comprehensive  learning plan
    • participate in regulatory practice consultation process,  and
    • an intensive  period of supervision in her new work environment
  • Ms. Whieldon will pay costs to BCCNP in the amount of $20,016.67 within one year of this order.

In its reasons, Discipline Panel found the nature and gravity of Ms. Whieldon's  conduct to be serious, favouring a more serious penalty. Read the full Reasons for Decision on Penalty and Costs (PDF).

This order is stayed pending Ms. Whieldon's appeal of the Discipline Panel's order of September 11, 2019 to the Supreme Court of British Columbia.
