Consent agreement

May 28, 2024

On May 28, 2024, a panel of the Inquiry Committee approved a consent agreement between BCCNM and the registrant to address concerns that they have a health condition that requires abstinence-based medical monitoring. The registrant has been declared unfit to practice and must submit to a further medical evaluation declaring them fit prior to returning to practice. The registrant was diagnosed with and admitted to a disability with a causal relationship to the practice via an independent medical report and they have agreed to comply with the treatment recommendations.

The registrant has voluntarily agreed to terms equivalent to a limit and/or condition on their practice, including:

  1. A condition that they submit to a further independent medical evaluation declaring them fit prior to returning to practice and an agreement to abide by any recommendations arising from that assessment.
  2. A limit that they enrol in medical monitoring for a term upon returning to practice including receiving regular reports evidencing their compliance with the terms of the medical monitoring.
  3. A limit that they not work night shifts, be the solo nurse on duty, assume nurse-in-charge duties, or have supervision over students for a term upon returning to practice.
  4. Disclosure of treatment recommendations to relevant employer representative(s).

The Agreement will remain in place for a minimum of 2.5 years of continuous nursing practice. The name of the registrant has been withheld in accordance with section 39.3 (4)(a) of the Health Professions Act for the purposes of not identifying a registrant or their personal health information respecting the condition that impaired their ability to practice nursing or midwifery.

The Inquiry Committee is satisfied that the terms will protect the public.
